
Overview:
The CEO of Optimal Woman, Inc. (OWI) has engaged you to continue
to work in the role of a management/HRM consultant. As a reminder,
the company has facilities in the eastern United States and
manufactures and distributes health and beauty aids for women over
age 40. Earlier you identified several areas of concern regarding
human resources management and presented strategies to bring the
organization into legal compliance.
You will assist the company in the capacity of guiding the company
ensuring legal HRM compliance as it plans expansion into new
markets over the next 3-5 years. Among the new markets, the
company aims to move into California and Mexico opening new
facilities where employment laws are different and cultural trends may
be more prevalent. Among the different laws and cultural trends
include, but are not limited to:
Legalized use of recreational marijuana
Mandatory or statutory sick pay
Aging workforce
Minimum wage requirements
Family Leave
International laws and regulations
Potential Issues:
Employees in some positions earn the federal minimum wage
per hour, but the minimum wage in some states is higher than
the federal minimum rate.
Some temporary and part-time new hires will work full time
hours for an unspecified number of weeks on an as needed
basis to establish the company in the new markets. These
employees are being forced to enroll in healthcare under the
ACA because they are not classified correctly by the
organization and are denied coverage under the company’s
health insurance plan. Note: for regular full-time employees,
employees are enrolled in the company’s healthcare plan on
the first of the month after 30 days of service.
Some office workers hope to organize through a labor union
because they believe there are poor and unfair working
conditions. The number of disgruntled office workers has
increased over the last several months.
Workers in the warehouse and distribution centers are
members of a local Teamsters union and contracts are set to
expire within a year. There are rumors that these employees
plan to strike if the company doesn’t meet their demands for
increased compensation, paid time off benefits, contributions
to their pension plan, and improvements to their current
medical and dental insurance plans.
Many of the employees mentioned are using social media to air
complaints and advance their cause sometimes while on
company time and using company property (computers,
tablets, and smartphones).
The organization (OWI) wants to meet the expected demands for all its
workers and needs to focus on cost during the expansion, which is
why your help is valuable during the planned expansion over the next
